Collection of Personal Information

By submitting your order either to our partner or to us you consent to the use of your personal information as set forth above, and to the transfer of that data to our partners or those individuals or entities we engage to provide services in connection with your transaction.

Management of Personal Information

Digital River tries hard to keep personal information accurate and up-to-date. If you find that your personal information is not accurate, please let us know. Digital River will use best efforts to investigate your concerns after we receive your inquiry and make the necessary corrections, additions and/or deletions.

Disclosure of Personal information

Digital River discloses your personal information directly to you upon your request; provided, however, that we may reject all or part of your request when: 1) the disclosure may harm the life, the body, the property and the other rights of yourself or the third parties, 2) the disclosure may lead the remarkable difficulties to the appropriate operation of our business or 3) the disclosure may lead a breach of the other laws and regulations.

Cookies and WebBeacons

We may use “Cookies” and other tracking technologies such as web beacons. “Cookies” are small text files that are transferred to your computer’s hard disk by the website. Digital River’s cookies are used to identify a computer or browser, not to identify specific customer traits. If you do not want cookies in your browser, you may set your browser to reject cookies or to notify you when a website attempts to place a cookie in your browser.

WebBeacons (also referred to as GIF files, pixels or action tags) help Digital River recognize a unique cookie on your browser. We use this tool to compile aggregate information about you, and it is not personally identifiable. This information includes IP addresses, search terms, domain names, and browser types. We use this information to track usage and other patterns on our Websites. We may share this aggregate information with our partners or service providers.

Sharing Personal Information

Digital River may receive personally identifiable information either from you directly or from our partner or supplier who provides us with the personal information to fulfill a service to you on their behalf. In some circumstances, personal information that Digital River receives from you directly may be provided to our partners or suppliers in order for them to fulfill a service to us for your benefit or directly to you. We may also provide your information in order to register your purchase with the manufacturer or service provider for warranty, technical support or similar purposes.

Digital River also employs other companies to provide services to us in connection with your transaction. We do use companies to process credit card payments, deliver packages, send mail, analyze data, provide marketing aid and assistance, provide customer service, and otherwise provide services to us to enable us to serve you and enhance our services. These organizations may have access to personal information as required to permit them to perform their obligations to us. Personal information may be stored and processed in the United States or any other country in which Digital River or its affiliates, subsidiaries, agents or partners maintain offices, and you consent to any transfer of this information outside of the country in which you reside by your use of this site.

Digital River may be required to respond to subpoenas, court orders or be asked to respond to other legitimate requests for your personal information from appropriate law enforcement or governmental authorities. We will not provide you with notice of such requests. In such situations, we will release personally identifiable information to third parties when we believe it is appropriate for us to do so in order to comply with the law or to protect against fraud. Digital River also reserves the right to report to such entities any activities that we believe to be unlawful. Any such report of the activities outline in (a) thorugh (e) will be made without prior notice to you, and you consent to such disclosure by us.

In the event Digital River merges with another entity, is acquired by another entity, or enters into a business combination with another entity, Digital River may be required to disclose some or all of your personally identifiable information to that entity to continue serving you.

Digital River is not in the business of selling, trading or renting personal information. We will not use or share your personally identifiable information with others except those individuals or entities which have a business relationship with Digital River.

Children’s Privacy

This site is not aimed to attract children and its objective is not to collect personal information from children. Anyone under the age of 18 should not use this site unless supervised by an adult. Digital River’s goal is to comply with applicable laws and regulations relating to collection and use of information from children, including the Children’s On-line Privacy Protection Act of the United States.

Security of Personal Information

Customers who buy through the Digital River system are shopping on a secure server which encrypts customer’s credit card information and passwords. This makes it difficult, if not impossible, for a third party to access or use your personal information in an unauthorized manner.

Digital River has developed its service with security as a top priority. We use firewalls to help prevent access to information in our system and Secure Socket Layers (“SSL”) to encrypt your personal information and protect it from disclosure, destruction, modification, or use.

Your Choices

You can decide whether or not to provide personal information to Digital River. However, if you do not provide personal information you may not be able to make purchases, enlist services or access certain offers or options that may be of benefit to you. At the time you provide your information, we will offer you a choice as to whether or not you wish to receive further communications about special offers, product information, or other marketing messages. We may provide this information to our business partners and suppliers. If you choose not to receive these communications, we will not use your personally identifiable information for this purpose.

PayPal Privacy Policy – Canada

We work with merchants to enable them to accept payments from you using PayPal. In doing so, a merchant may share information about you with us, such as your email address, when you attempt to pay that merchant. We use this information to confirm to that merchant that you are a PayPal customer and that the merchant should enable PayPal as a form of payment for your purchase.

Regardless, we will not disclose your credit card number or bank account number to anyone you have paid or who has paid you through PayPal, except with your express permission or if we are required to do so to comply with a subpoena or other legal process.

How we share personal information with other parties

We may share your personal information with:

* Members of the eBay Inc. corporate family — like eBay, Shopping.com or Skype — to provide joint content and services (like registration, transactions and customer support), to help detect and prevent potentially illegal acts and violations of our policies, and to guide decisions about their products, services and communications. If you are buying goods or services and pay through PayPal, we may also provide the seller with your confirmed credit card billing address to help complete your transaction with the seller. The seller is not allowed to use this information to market their services to you unless you have agreed to it.

We work with merchants to enable them to accept payments from you using PayPal. In doing so, a merchant may share information about you with us, such as your email address, when you attempt to pay that merchant. We use this information to confirm to that merchant that you are a PayPal customer and that the merchant should enable PayPal as a form of payment for your purchase.

Regardless, we will not disclose your credit card number or bank account number to anyone you have paid or who has paid you through PayPal, except with your express permission or if we are required to do so to comply with a subpoena or other legal process.

How we share personal information with other parties

We may share your personal information with:

* Members of the eBay Inc. corporate family — like eBay, Shopping.com or Skype — to provide joint content and services (like registration, transactions and customer support), to help detect and prevent potentially illegal acts and violations of our policies, and to guide decisions about their products, services and communications. Members of our corporate family will use this information to send you marketing communications only if you have requested their services.
* Service providers under contract who help with parts of our business operations; (fraud prevention, bill collection, marketing, technology services). If you do not want PayPal to share your personal information with other financial institutions for the purpose of marketing our jointly offered products to you, please log in to your account and uncheck the box in the Information Sharing section of the Notifications and Information Sharing page. This page can be accessed by going to the Profile subtab under the My Account tab.

You can also control how we use your contact information to market our services to you in the notifications preferences.
